ELD Mandate: Exemption Qualification

Understanding the ELD mandate has been a priority for many fleet managers and independent owner-operators since the mandate was announced. By now, most people know about the deadline, and the important dates for compliance, but there are many important details within the mandate that need to be understood prior to the deadline. One of the most important details to know is the exemption rule, and who it applies to. Knowing which types of vehicles, and what weekly or monthly hour requirements demand the use of an ELD or not, will ensure that your fleet or truck are properly compliant before the December 18 deadline.

Who is required to comply?

The FMCSA’s ELD mandate applies to almost every carrier or driver that is required to keep records of duty status or RODS. According to the FMCSA website, the rule also “applies to commercial buses as well as trucks, and to Canada- and Mexico-domiciled drivers.” If this applies to you or your fleet, then chances are that you will need to comply with the mandate by December 17th of this year.

Who is exempt?

While the mandate does appear to be all-inclusive, there are a few instances of exemption that should be reviewed:

  • “Drivers who operate under the short-haul exceptions may continue using time cards
    (sic); they are not required to keep RODS and will not be required to use ELDs.”
  • “Drivers who use paper RODS for not more than 8 days out of every 30-day period.”
  • “Drivers who conduct drive-away-tow-away operations, in which the vehicle being driven
    is the commodity being delivered.”
  • “Drivers of vehicles manufactured before 2000.”

If any of these apply to you, then you may be exempt from the mandate. Visit the FMCSA website if you have any concerns about your inclusion in the mandate.
